Please read these Terms of Service carefully before using IsMailable.com. By using our service, you agree to be bound by these terms.

2Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the email verification services provided by IsMailable (“IsMailable”, “we”, “us”, or “our”) at https://ismailable.com (the “Site”) and any related APIs, products, or services (collectively, the “Services”).
By using the Services you agree to these Terms. If you do not agree, do not use the Services.
3Definitions
"Account" — your registered user account on the Site.
"User(s)" — any individual or entity using the Services.
"Verification Request" — a single email verification API call.
"Bulk/List Verification" — a batch upload of email addresses for verification.
"Results" — the verification outputs returned by the Service.
"Free Tier" — 100 verification credits per month provided free of charge.
"paddle" — the current third-party payment processor (Merchant of Record).

5Eligibility & Account Registration
Minimum age: You must be at least 16 years old to register and use the Services.
Account information: You must provide accurate, complete, and current information and keep it up to date. You are responsible for all activity under your Account.
Multiple accounts: We allow reseller and enterprise accounts; each user is expected to maintain a single Account unless explicitly permitted (e.g., separate corporate accounts). Abuse of multiple Accounts to evade limits will result in suspension.
Free trial & Free Tier: New Accounts receive 100 verification credits as a trial, and all Accounts receive a 100 credits/month free tier (subject to change with notice).
6Service Description & Usage Rules
Overview: IsMailable offers real-time single email verification, Bulk/List verification (CSV or compatible formats), and a REST API that performs checks including DNS/MX, SMTP handshake (where available), disposable/temporary address detection, role-based address detection, spam-trap indicators, and other deliverability heuristics.
Single verification storage: Single verification calls are not stored in our systems. The result is returned to the caller and not retained.
Bulk/list verification storage: Bulk/List verification results are stored to permit user download and management for a limited time. See Section 6 (Data Retention & Deletion).
Rate limit: Default rate limit is 100 requests per minute per Account. We may modify limits for paid tiers, and retain the right to throttle or block abusive traffic.
Exports: During the 14-day retention window, users may download results for bulk uploads in common formats (CSV/JSON). After deletion (see Section 6) results are unrecoverable.
Over-usage: If you exceed plan limits, access will be blocked until limits reset or you upgrade. We will notify you before blocking where possible.
No SLA guarantee: We do not provide a formal SLA guaranteeing uptime; historically we target ~99% availability. We reserve the right to change or discontinue any feature.
7Data Retention, Ownership & Privacy (summary — see DPA/Privacy Policy)
Ownership: You own all Results generated by your use of the Services. We claim no ownership over your submitted data or resulting verification outputs.
Single verification retention: Results from single verification calls are not stored.
Bulk verification retention: Results for Bulk/List verifications are stored so you can review and download them. All such stored Results will be permanently deleted automatically 14 days after processing (i.e., on day 15 results are deleted).
Deletion on request: Users may request earlier deletion or export of stored Bulk/List Results by contacting contact@ismailable.com. We will act on verified requests promptly.
No training on user data: We do not use your raw verification results to train models or in product development; our engines are developed internally and do not rely on sharing or training with user data. Aggregate anonymized metrics (non-identifiable) may be used for service telemetry and improvement.
Subprocessors & hosting: We use reputable third-parties (e.g., AWS, Supabase, VPS providers, other infrastructure) to host and process data. Where required, we will enter subprocessors agreements and will list subprocessors in the Privacy Policy or DPA.
Data export: Users can download Bulk/List verification results during the retention window (14 days). After automatic deletion results cannot be recovered.
Data subject rights: We will honor data subject requests (access, correction, deletion) submitted to contact@ismailable.com in accordance with applicable law and our DPA/Privacy Policy.
8Security
Measures: We store user credentials using industry-standard encryption/hashing and use TLS for data in transit. Our infrastructure is hosted on secure providers (AWS, Supabase, etc.) and configured following industry best practices. We perform routine security maintenance.
No absolute guarantee: While we take reasonable measures, we cannot guarantee absolute security.
Breach notification: If we discover a security incident compromising user data, we will notify affected users via the email on file within 48 hours of our becoming aware. Where applicable we will notify supervisory authorities within 72 hours (or as required by law).
Security cooperation: Users must also take reasonable measures to secure credentials and notify us immediately at contact@ismailable.com if they suspect unauthorized access.
9Acceptable Use Policy (AUP)
Prohibited Uses (non-exhaustive):
- Using Results to send unsolicited bulk email/spam.
- Using the Services to harvest addresses, scrape third-party systems, or otherwise harvest data in violation of law.
- Attempting to access mailboxes or content you are not authorized to access.
- Using the Service to facilitate wrongdoing (fraud, phishing, harassment, stalking).
- Using multiple Accounts to evade rate limits or free-tier caps.
10Reselling, Credentials & Enforcement
Reselling: You are permitted to resell the Service/API (i.e., provide access to your customers) but you may not resell, publish, or otherwise distribute verification Results that include personal data of third parties. Resellers must ensure their customers comply with these Terms.
Credentials: You must not share your Account credentials publicly. Accounts may be suspended for credential sharing that causes security or privacy risks.
Enforcement: Violations may result in warnings, throttling, suspension, termination, and/or legal action.
11Pricing, Billing, Refunds & Chargebacks
Pricing model: We operate on a monthly subscription model. Prepaid credits may be introduced in future with prior notice.
Billing and payment processor: Payments are processed through paddle (Merchant of Record). You agree to paddle’s terms where applicable. You are responsible for providing valid billing details and maintaining payment methods.
Taxes: paddle will handle VAT/GST calculation and remittance where applicable. You are responsible for local taxes that remain your obligation under law.
Refund policy (purchases): Monetary refunds for purchases are handled by paddle according to paddle’s policies. Our policy: you may request a refund within 14 days of purchase if you have used no more than 10% of your allotted credits for that billing period. Requests are evaluated and processed via paddle.
Downtime credits: For verified service downtime you may request service credits (not monetary refunds). Requests must be submitted within 7 days of the downtime event. Credits, when approved, are issued within 48 hours to your Account balance. Credits are at our sole discretion and do not create a monetary liability.
Chargebacks: If you initiate a chargeback, we reserve the right to: (a) immediately suspend or terminate your Account; (b) recover any associated chargeback fees/costs from you; and (c) withhold or deduct funds or credits from your Account to cover chargeback losses. Repeated chargebacks may result in permanent termination and referral for collection.
12Overages & Limits
If you exceed the request allotment for your plan: we will block further requests until the next billing cycle or until you upgrade to a higher plan. We will attempt to notify you before blocking where practical.
For paid plans you may optionally enable overage billing if and when offered; otherwise blocking is enforced.
13Intellectual Property
IsMailable retains all rights, title and interest in the Services, platform, software, inventions, trademarks, and documentation.
You retain ownership of the data you submit and all Results produced for your Account. You grant IsMailable a limited, nonexclusive license to access and process that data solely to provide the Services and to comply with legal obligations.
Feedback license: If you provide feedback, suggestions, or enhancements, you grant IsMailable a perpetual, royalty-free license to use such feedback.
14Termination & Suspension
Suspension: We may suspend Accounts immediately for AUP violations, fraud, abuse, or nonpayment.
Termination: We may terminate Accounts with notice for material breach or without notice for serious violations (spam, harvesting).
Post-termination data: On termination, your Account will be disabled immediately. Stored Bulk/List Results will be retained for up to 14 days for recovery or legal reasons and then permanently deleted. After deletion, data is irrecoverable.
Refunds on termination: Refunds follow Section 9 and are issued via paddle where eligible.
15Disclaimers & Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. ISMAILABLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE PROHIBITED BY LAW.
No guarantee of deliverability: Verification improves understanding of deliverability risk but does not guarantee that an email will be delivered to an inbox.
16Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ISMAILABLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.
LIABILITY CAP: ISMAILABLE’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO ISMAILABLE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. (If you prefer a fixed cap instead, replace with a fixed USD amount.)
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability — to the extent local law applies, those provisions may be adjusted but the remainder of these Terms remain in effect.
17Indemnification
You agree to indemnify, defend, and hold harmless IsMailable and its officers, employees, and agents from any third-party claim arising from:
a. Your use of the Services in violation of these Terms;
b. Your violation of any law or third-party rights;
c. Reseller or third-party customer misuse of Results;
d. Your failure to secure credentials or Data Subject requests processing.
18Payment, Billing & Merchant Details (additional)
Payment processor: paddle is our current payment provider. By purchasing you agree to paddle’s terms. We may change processors with notice and update this section.
Currency & billing: All prices are displayed in USD unless otherwise shown. Recurring subscriptions auto-renew. You are responsible for all fees, taxes, and chargebacks.
19Support, Credits & Downtime Process
Support channels: Contact support at contact@ismailable.com. We endeavor to respond to emails and live-chat messages within 24 hours; response times may increase during weekends or holidays.
Downtime credits: To request downtime credits, submit a support ticket within 7 days of the incident. Approved credits will be applied within 48 hours.
20Export Controls, Sanctions & Compliance
You may not use the Services in violation of export or sanctions laws. We may refuse service to any person, entity, or jurisdiction subject to sanctions.
You represent that you are not a person or entity on any restricted party list.
21Arbitration & Governing Law
Governing law: These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules.
Arbitration: Binding arbitration will be the exclusive method to resolve disputes. The arbitration will be held in Bangladesh under the following terms:
SEAT / VENUE (CITY): Sylhet, Bangladesh
Class action waiver: You and IsMailable each waive the right to participate in a class action or class-wide arbitration.
22Notices, Changes & Updates
Notices: We deliver notices to the email on file or by posting on the Site. Legal notices should be sent to contact@ismailable.com.
Changes: We may modify these Terms. We will notify users by email at least 14 days before changes to price, material terms, or privacy practices. Continued use after the effective date constitutes acceptance.
23Force Majeure, Severability, Assignment
Force majeure: We are not liable for delays caused by events beyond our reasonable control (natural disasters, strikes, internet outages, acts of government, pandemics).
Severability: If a provision is invalidated, the remainder stays in effect.
Assignment: You may not assign your rights without prior written consent. We may assign these Terms in connection with sale/transfer of the business.
24Additional Legal Items Specific to IsMailable
No resale of Results: You may resell the Service but may not resell or publicly share the personal Results of third parties. Doing so may violate privacy laws.
Logs & metadata: We may retain necessary logs/metadata for operational, security, and legal purposes. These logs do not contain full Results beyond the 14-day retention window for Bulk/List results.
DPA and Privacy Policy: We maintain a separate Privacy Policy and will provide a Data Processing Addendum (DPA) to enterprise customers on request. The DPA will detail controller/processor roles, subprocessors, security measures, and legal tools for cross-border transfers (e.g., SCCs if required).
